Linus Dunkers Acquitted in Landmark Cryptocurrency Case

In a significant legal case involving cryptocurrency operations, former Köping resident Linus Dunkers has been acquitted by the Svea Court of Appeal, ending a prolonged legal battle.

A Journey from Tech Enthusiast to Bitcoin Entrepreneur

Linus Dunkers, a self-proclaimed tech enthusiast, made his mark as an entrepreneur in the digital currency space, focusing on Bitcoin. From 2016 to 2021, he lived in Köping and ran his cryptocurrency operations from locations in Arlaberget, Kolsva, as well as in former industrial spaces in Kolsva Gjuteris and Sandvik in Köping.

His involvement in the cryptocurrency world led him into a dispute with the Swedish Tax Agency (Skatteverket), which ultimately resulted in Dunkers being sentenced by the Västmanland District Court to 14 months in prison for serious tax offenses and a ban on conducting business. Additionally, the Enforcement Authority (Kronofogden) seized all his assets.

A Fight for Justice

Throughout this legal struggle, Dunkers maintained that he had always made efforts to stay informed and act in accordance with the prevailing regulations. He emphasised that cryptocurrency was still relatively new, and he had sought guidance from various authorities to ensure he was following the rules correctly.

The Court of Appeal’s Verdict

The Svea Court of Appeal has now delivered a unanimous verdict, acquitting Dunkers of all charges. The court determined that the intent required for a conviction was lacking, given the nature of the circumstances at the time. Court Chair Maria Hölcke stated that the handling of cryptocurrency was still relatively novel during the period in question, especially in terms of taxation. The court took into account that Dunkers had made several attempts to seek clarity from different authorities regarding his activities, which played a crucial role in their decision.

In addition to clearing him of tax-related charges, the court also dismissed two counts of aggravated accounting offences. According to the Court of Appeal, these offences were downgraded to normal severity and had therefore reached the statute of limitations.

Linus Dunkers, now residing in Malta, expressed his relief when reached for comment. “It’s an incredible relief to finally have my name cleared. It’s hard to comprehend this new reality to be an acquitted man,” he said. “The Court of Appeal has acquitted me on all three charges. It’s a tremendous feeling of freedom and a restoration of my reputation.”

The case sets a noteworthy precedent for cryptocurrency-related legal matters in Sweden and serves as an example of the complexities involved in navigating regulations in an emerging industry.
